1. How to Contact Us

1.1      Who is PS Training and Development: We are a registered organisation under England and Wales under company number 12167733.
Our registered premises is at 31 Stockwood Crescent, Luton, LU1 3SS

1.2      PS Training and Development can be contacted via email at admin@pstraining.online or by phone at (0044) 02035765947.

1.3      Our office hours are Monday to Friday, 9:00 AM to 5:00 PM.

2. Booking Courses/Training with Us

2.1      To book courses or training with PS Training and Development, individuals or organisations must fill out our online booking form available on our website or contact us directly via email or phone.

2.2      A contract will come into existence on acceptance of a booking.

2.2      Bookings are accepted in writing via e-mail

3. Your Rights to Make Changes

3.1      You have the right to make changes to your booking up to 14 days prior to the scheduled start date of the course or training. Any changes made within 14 days of the start date will be subject to additional fees.

3.2      The schedule of cancelation fees are as follows:
Cancelation prior to 14 days: 0% cancellation fee
Cancelation between day 14 and day 7  :25% cancellation fee
Cancelation between day 7 and day 4     :50% cancellation fee
Cancelation within 72 hours (3 days)       :75% cancellation fee
Cancelation on the day                               :100% cancellation fee

4. Our Rights to Make Changes to Course Content

PS Training and Development reserves the right to make changes to the content, timing, or delivery method of courses or training sessions as deemed necessary. We will inform participants of any significant changes in advance.
 

5. Rights to Transfer Booking

Participants may transfer their booking to another individual or organisation upon prior written approval from PS Training and Development. Transfer requests may be subject to administrative fees.

6. Rights to Remove from Learning, Course, or Training

PS Training and Development reserves the right to remove any participant from a course or training program if their behaviour is deemed disruptive or inappropriate, without providing a refund.
 

7. Your Rights to End a Contract with PS Training

You have the right to end a contract with PS Training and Development, provided the course or training has not commenced. Cancellation fees apply as follows:
Cancelation prior to 14 days: 0% cancellation fee
Cancelation between day 14 and day 7  :25% cancellation fee
Cancelation between day 7 and day 4     :50% cancellation fee
Cancelation within 72 hours (3 days)       :75% cancellation fee
Cancelation on the day                               :100% cancellation fee

 

8. How to End a Contract with PS Training

To end a contract with PS Training and Development, individuals or organisations must notify us in writing via email or letter, stating their intention to cancel the booking.

9. Our Rights to End a Contract

PS Training and Development reserves the right to end a contract with participants or organisations if they fail to comply with our terms and conditions, without providing a refund.
 

10. How to Alert PS Training of Any Problems

If you encounter any problems during your course or training, please contact PS Training and Development immediately via email or phone to resolve the issue, alternatively any issues can be communicated with via the trainer on the day of training.

11. Price and Payment

Prices for courses and/or training are listed on our website and are subject to change without notice. Payment must be made in full prior to the start date of the course or training, unless otherwise agreed upon in writing.
 

12. Our Responsibilities for Loss and Damage if You Booked as an Individual Directly

PS Training and Development is not liable for any loss or damage incurred by individuals who booked directly with us, except in cases of negligence or wilful misconduct on our part.
 

13. Our Responsibilities for Loss or Damage if You Booked as an Organisation

If an organisation booked courses or training with PS Training and Development, our liability for any loss or damage is limited to the total amount paid for the booking, except in cases of negligence or wilful misconduct on our part.

 

14. How We Use Personal Data

PS Training and Development respects the privacy of our customers and complies with all relevant data protection laws. We use personal data collected during the booking process solely for the purpose of providing our services and will not share it with third parties without consent, except as required by law.

How We Process Personal Data for Business Customers
 

14.2.1 Data Controller and Data Processor Relationship:

  • You, as the business customer, are the Data Controller, and PS Training and Development is the Data Processor regarding the personal data provided to us.

  • We utilize this data for booking purposes, sending joining instructions to delegates, providing training, and issuing certificates.

14.2.2 Use of Personal Data:

  • We will solely utilize personal data for the aforementioned purposes or as per your instructions as the Data Controller, except where required by law.

  • In such cases, we will notify you unless prohibited by law, and we will inform you if any instructions breach data protection legislation.

14.2.3 ID Verification:

  • Certain courses may necessitate delegates to provide proof of identification.

14.2.4 Accessibility Information:

  • Information provided by you regarding making courses accessible to your delegates will be used solely for that purpose.

14.2.5 Assessment Methods:

  • Trainers will employ continuous observation and other appropriate methods to assess if delegates meet course standards.

14.2.6 External Accreditation:

  • If a course is externally accredited, we will provide delegate details and course outcomes to the awarding body, which then becomes the data controller for that information.

14.2.7 Communication Preferences:

  • We will send emails to your staff regarding refresher training and certificate expiration reminders unless you opt out by contacting our admin team.

14.2.8 Assistance with Data Protection Impact Assessment:

  • We will provide reasonable assistance in preparing any data protection impact assessment prior to processing provided personal data.

14.2.9 Security Measures:

  • Appropriate technical and organisational measures will be implemented to maintain data security.

14.2.10 Staff Training and Confidentiality:

  • Our staff with access to personal data will undergo training and will uphold confidentiality standards, refraining from disclosing data unless directed otherwise by you or as permitted by these terms.

14.2.11 Data Transfer:

  • Personal data will not be transferred outside the European Economic Area (EEA) except as per your written instructions.

14.2.12 Breach Notification:

  • We will promptly notify you of any personal data breach and assist in meeting your obligations under data protection legislation.

14.2.13 Subject Access Requests and Complaints:

  • We will promptly notify you upon receiving a Subject Access Request, request to erase personal data, or any other communication related to data protection legislation or regulatory authority directives.

14.2.14 Third-Party Contracts:

  • External companies engaged in issuing training certificates on our behalf are bound by written contracts.

14.2.15 Third-Party Authorisation:

  • No other third parties will process personal data without your prior written consent, and contractual agreements will be established with any sub-processors.

14.2.16 Record Keeping:

  • We will maintain records of personal data processing conducted on your behalf.

14.2.17 Audit Facilitation:

  • Audits of our data processing activity can be conducted by you or your designated auditor.

14.2.18 Data Deletion or Return:

  • Upon your instructions, we will delete or return all personal data, unless retention is required by law. Training records are retained for 5 years unless otherwise instructed.

14.2.19 Post-Course Communication:

  • At the course's conclusion, we may request delegate consent to continue communication via email about our other services and charity support, becoming the Data Controller for that personal data.

 

15. Intellectual Property Rights

All intellectual property rights associated with our courses, training materials, and apprenticeships belong to PS Training and Development. Participants are prohibited from reproducing, distributing, or using our materials for commercial purposes without prior written consent.
 

16. Other Important Terms

These terms and conditions constitute the entire agreement between you and PS Training and Development and supersede any prior agreements or understandings. We reserve the right to update or modify these terms and conditions at any time, and such changes will be effective immediately upon posting on our website. It is your responsibility to review these terms periodically for any updates or changes.
